TERMS AND CONDITIONS OF SALE AND WEBSITE USE

1. INTRODUCTION AND ACCEPTANCE
These Terms and Conditions ("Terms") govern your access to and use of the website beardeaseskincare.co.za ("the Site") and the purchase of any products ("Products") from BANYAN REMEDIES (PTY) LTD, trading as BeardEase™ Skincare ("we," "us," "our"). By accessing the Site, placing an order, or using any of our Products, you ("you," "your," "customer") agree to be bound by these Terms in full. If you disagree with any part, you must not use our Site or purchase our Products.

2. PRODUCT INFORMATION & HEALTH DISCLAIMER
2.1. Product descriptions, imagery, and specifications on the Site are provided for informational purposes. While we strive for accuracy, slight variations may occur. Colours may appear differently on various screens.
2.2. Cosmetic Product Disclaimer: Our Products, including the BeardEase™ Ingrown Hair Treatment Cream, are topical cosmetics formulated for general use. They are not pharmaceutical drugs, medical devices, or intended to diagnose, treat, cure, or prevent any disease.
2.3. Patch Test & Allergic Reactions: We strongly recommend performing a patch test before full use. Apply a small amount of Product to a discreet area of skin and wait 24 hours for any adverse reaction. Discontinue use immediately if irritation, redness, or discomfort occurs and consult a healthcare professional.
2.4. Individual Results: Results from using our Products may vary based on individual skin type, condition, and compliance with usage instructions. We do not guarantee specific outcomes.

3. INTELLECTUAL PROPERTY
3.1. All content on this Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of BANYAN REMEDIES (PTY) LTD or its content suppliers and is protected by South African and international copyright, trademark, and other intellectual property laws.
3.2. The trademarks "BeardEase™," the BeardEase™ logo, and all related branding are registered or pending trademarks of BANYAN REMEDIES (PTY) LTD. You may not use them without our prior written permission.

4. ORDERS, PRICING, AND PAYMENT

4.1. Placing an item in your cart or completing the checkout process constitutes an offer to purchase. All orders are subject to our acceptance, which we may withhold at our sole discretion.

4.2. We reserve the right to correct any pricing errors, even after an order is placed, and to cancel orders arising from such errors.

4.3. Prices are listed in South African Rand (ZAR) and are exclusive of VAT unless otherwise stated. The final amount payable will include applicable taxes and shipping fees as displayed at checkout.

4.4. Payment must be made in full before an order is dispatched. We accept major credit/debit cards and other payment methods as indicated on the Site, processed securely via our authorised third-party payment gateways (e.g., Yoco).

4.5. PAYMENT SECURITY & DISCLAIMER:
We are not liable for any payment discrepancies, failures, errors, or security breaches that occur during the transaction process. This includes, but is not limited to:

  1. Third-Party Payment Gateway Glitches: Technical errors, downtime, or processing failures on the part of our payment service providers.
  2. Bank/Financial Institution Issues: Declined transactions, holds, or errors originating from the customer's bank or card issuer.
  3. Fraud & Phishing: We are not responsible for any financial loss due to phishing scams, fraudulent websites impersonating us, or unauthorized use of payment details. Customers are responsible for ensuring they are on our official website (beardeaseskincare.co.za) and for the security of their own payment credentials.
  4.  Currency Conversion Errors: Discrepancies due to exchange rates or fees applied by the customer's bank for international transactions.

It is the customer’s responsibility to ensure payment details are entered correctly and to verify the successful completion of a transaction with their bank. In case of a suspected failed transaction where funds were deducted, the customer must contact their bank or card issuer first. We will only act on order confirmations generated by our payment system.

4.6. Order Confirmation:

A valid, automated order confirmation email from our system no-reply@shopify.com or info@beardeaseskincare.co.za constitutes our official acceptance of your order. However, we reserve the right to perform additional verification before dispatching any order.

Final verification of a successful payment requires the following:

Our payment gateway's confirmation of a completed and cleared transaction. We are not bound to fulfill any order where the payment status is disputed, pending, reversed, or where the transaction cannot be independently verified by our bank and financial records. In case of discrepancy, the transaction logs of our authorised payment gateway and bank shall be deemed conclusive evidence of the payment status.

5. SHIPPING, DELIVERY, AND RISK
5.1. We endeavour to process and dispatch orders within [e.g., 2-3] business days. Delivery times provided by our courier partners are estimates only. We are not liable for delays caused by the courier, customs, or events beyond our reasonable control (force majeure).
5.2. Risk of loss and damage to Products passes to you upon delivery to the address you provided. It is your responsibility to inspect Products upon delivery and report any visible damage to the courier and us immediately.

6. RETURNS, REFUNDS, AND WARRANTY
6.1. Due to the intimate and hygienic nature of cosmetic Products, we do not accept returns or offer refunds for Products that have been opened, used, or tampered with.
6.2. Damaged or Faulty Goods: If you receive a Product that is physically damaged, faulty, or materially different from what you ordered, you must notify us within 7 days of receipt with photographic evidence. We will, at our sole discretion, replace the Product or issue a full refund.
6.3. Incorrect Item Received: We will arrange for the correct item to be sent and provide a prepaid return method for the incorrect item.

6.4. Limited Product Warranty and Order Accuracy: Our Products are guaranteed against manufacturing defects for a period of 3 months from the date of purchase. This warranty does not cover damage from misuse, improper storage, or normal wear and tear.

6.5 If you receive an incorrect item, we will replace it at no additional cost to you. However, if an incorrect or change of item is ordered by the customer, the customer will be responsible for the shipping costs associated with returning or replacing the item, as well as any adjustments to the product price that may apply.

7. LIMITATION OF LIABILITY
7.1. To the fullest extent permitted by applicable law, BANYAN REMEDIES (PTY) LTD, its directors, employees, and affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
(a) Your use or inability to use the Site or Products;
(b) Any unauthorized access to or use of our servers and/or any personal information stored therein;
(c) Any interruption or cessation of transmission to or from the Site;
(d) Any bugs, viruses, or the like transmitted to or through the Site by any third party;
(e) Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site.
7.2. Our total cumulative liability to you for all claims arising from or related to these Terms or the Products, whether in contract, delict (tort), or otherwise, shall not exceed the total purchase price you paid for the specific Product giving rise to the claim.

8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless BANYAN REMEDIES (PTY) LTD and its officers from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your use of the Site, or your violation of any law or the rights of a third party.

9. GOVERNING LAW AND DISPUTE RESOLUTION
9.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
9.2. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of South Africa.

10. GENERAL
10.1. Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force.
10.2. Changes to Terms: We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site after changes constitutes acceptance.
